The TEC Doesn't Take Stickers

So like Josh mentioned, when David Van Os stickers are making their way around the floor of the convention, it's pretty much official that he's running for chair. As that's a public statement of candidacy, the Texas Ethics Commission would likely think so too. So should there be concern that a TEC spokesman confirmed that they have not received Van Os' filing?

I would imagine not — Van Os has done this before, and he must be aware that you have to file with the TEC before making any public announcements of candidacy, particularly ones with expenditures attached. And if he sent his filing in by mail, the postmark date counts as his date of filing. So it's possible the TEC simply hasn't received it yet. Nevertheless, the question mark remains. Whether the open question will affect his run for chair remains to be seen.

The Texas Ethics Commission currently has two active campaign treasurer appointments on file for candidates for the office of state chair of the Democratic Party - Boyd L. Richie and Roy LaVerne Brooks.

A candidate is a person who knowingly and willingly takes affirmative action for the purpose of gaining nomination or election to public office (which includes state chair of a political party).

Examples of affirmative action include the making of a public announcement of a definite intent to run for public office in a particular election, and before a public announcement of intent, the making of a statement of definite intent to run for public office and the soliciting of support by letter or other mode of communication.

A campaign treasurer appointment that is filed by mail with the proper address and postage is considered to have been filed on the postmark date.
